Seven years on, DCEC cannot prosecute suspects

Justice Key Dingake is scheduled to make a ruling in a case in which two fraud suspects, David Tumagole and Abraham Marumo, approached the High Court to seek a permanent stay of prosecution. The crimes were allegedly committed in 2005.

It is alleged that the two men defrauded several institutions in Botswana and South Africa of an amount approximated at P10 million. The Directorate of Corruption and Economic Crimes impounded their vehicles in 2005. They were formally charged in 2010, but there is nobody to prosecute them.According to their lawyers Enock Mazonde and Thata Masalila, the impounding of vehicles has seriously inconvenienced the two men's social lives and economic situation. The attorneys argued that the DCEC has been sitting on the case for more than five years and blames the complexity of the matter as an excuse for the delay. The suspects were arraigned in 2010.Justice Dingake enquired from the Directorate of Public Prosecutions why they have not made any progress since.Reading from the court record, he said the DPP and DCEC spent two years, between 2005 and 2007, doing nothing on the case. It was only on two occasions in mid-2007 that DCEC received information from South Africa.  "How can I then hold that stay is not appropriate under these circumstances?" he enquired from DPP who had no clear answers.Justice Dingake wondered how DCEC and DPP could impound vehicles belonging to suspects, warn them of the charges, and then sit back and do nothing. He reserved ruling for some time this week.
