Woman has case to answer in Mphathi suit

FRANCSITOWN: Chief Magistrate, Peggy Madandume ruled on Thursday that the state has established a prima facie case against a woman who allegedly intimidated the wife of Botswana Ash mine boss, Montwedi Mphathi.

The case is set to continue from October 20 after defence counsel, Isaac Seleka, failed in his 'no case to answer' application for his client, One Gwafila. The woman is accused of causing unlawful injury to Vinga, Mphathi's spouse.She is alleged to have committed the offences through intimidating cellphone messages.

In the previous mention in February, proceedings were adjourned after one of the defence attorneys, Tshekiso Tshekiso, objected to the evidence of Robert Mathumo, Orange Botswana legal administration officer.Tshekiso stated that Mathumo did not provide the court with mobile phone text communication between Vinga and Gwafila as reflected in the charge sheet but was giving evidence of voice communication. He said Mathumo had told the court that he was not the person who extracted the information showing the alleged text communication between Gwafila and Vinga.
