Multiple murder case judgement today

FRANCISTOWN: Justice Moses Chinhengo is expected to deliver judgement in the case in which a relative allegedly murdered a Zimbabwean lawyer, Patricia Majoko, her two children and their maid six years ago in Francistown.

The accused, a former file clerk at Majoko & Majoko and Partners, Gerald Dube is charged with the murder of attorney Majoko, the two children, Amotjilani and Dumisani, together with their maid Lindiwe Ncube.
It is alleged that the accused person, on September 13, 2001 allegedly murdered the family at their home at Molapo Estate Suburb, in Francistown.
The marathon case has been pending for over two years when it was adjourned sine die when Dube submitted that he had irreconcilable differences with his then lawyer, Duncan Morotsi.
Dube had also applied for the presiding judge, Justice Chinhengo, to recuse himself from the case since they were both Zimbabweans.
His application was quashed because "it was not a basis for recusal". Since then, the case has been adjourned several times.
Meanwhile, the prosecution has submitted that the murder was premeditated. "The motive derives from the accused pretending that he was a lawyer. (When he was found out) he was dismissed from the Majoko firm.
"He was deprived of the motor vehicle assigned to him by the company on September 10, 2001. He lost his home.
"Basically he was vagabond," argued the prosecution. He deliberately devised means to go and kill Ms. Majoko," the prosecution asserts.
Dube's lawyer, Ookeditse Maphakwane, said the state has successfully argued the first and third elements of the case.
He, however, pleaded that his client suffered epileptic fits, which he held accountable for his behaviour on the day that he allegedly killed his relatives.
He said Dube suffered a fit on September 7, 2001 running on to 'the following days'.
"The accused has been consistent that he did not know what happened. He never denied anything.
"This indicates his frankness and honesty of how he came to be involved," submitted Mapha-kwane.
