Francistown West by-election: the BDP blinked

Following the court order that barred the registration of its candidate with the IEC for the Francistown West by-election, the ruling BDP had two options for redress: either to withdraw the by-election writ and issue a new one in order to start the process afresh and enable its candidate to stand, or take the legal route and challenge both the court order and the IEC's refusal to register its candidate. It chose the legal route.

 

Reversing the court order would have been the ideal outcome for many reasons, but an evaluation of the two options could have established that the legal route was not the best option. It was going to be fraught with pitfalls without any guarantee of success.
