Justice Dr Ookeditse Maphakwane of the Lobatse High Court has confirmed a rule nisi recently granted to Water Utilities Corporation (WUC), stating that the actions of Tianyuan Construction and G & M Building Joint Venture to lock out and deny the Corporation and its employees' entry and access to the chambers to the water tanks for the supply of water to the villages of Ditlharapa, Molete, and Mokatako villages constitute an act of spoliation. Alternatively, an act of self-help and therefore null and void.

Spoliation is an old common law remedy commonly used by a person who has been dispossessed of goods without following due legal procedure.

The JV had, in protest, locked up chambers for the project termed Goodhope District water supply Scheme 2.2. awarded for P549.6 million.
