Government was to repossess the plots after the state secured conviction over the plots, which were the centre of controversy. However, Nchindo Jr approached the High Court and was given a temporary breather pending appeal. The court agreed that it would be grossly irregular if the state was allowed to repossess the disputed plots while the appeal against Lot Moroka's convictions and sentence were pending.
Nchindo and Matome were jointly convicted of fraud and corruption related to the acquisition by former Debswana managing director ,Louis Nchindo, of the two plots, which are in Gaborone owned by Debswana. Thus the High Court had ordered that the state should not repossess the said plots as per the magistrate's order, but rather wait until the High Court has decided the appeal. Moroka had sentenced Matome to three years imprisonment, while his co-accused, Garvas, son of the late Nchindo, was given a suspended sentence.
