Magistrate Slams Prosecution In Theft Case

FRANCISTOWN: Chief Magistrate, Lorraine Makati-Lesang condemned the prosecutor in a theft case last week saying that his predicament should not prejudice suspects.

The magistrate was responding to an application by the prosecutor Nicholas Kadiatla that two civil servants accused of theft should be remanded in custody to allow the prosecution to search for the stolen property.

Kadiatla said that the police have not been able to search for the stolen property because there was no fuel for the vehicles they were supposed to use for the task.
Makati-Lesang said that it was not the accused person's fault that the state was in that predicament as they qualified for bail.The magistrate said that the police should have tried by all means to use any vehicle to search for the property to avoid prejudice.
"The predicament of the state should not interfere with the accused persons. You have to have back up.
