Riverwalk suit postponed to August

The High Court in Lobatse yesterday postponed to August 27 a case in which a ruling party councillor in Thabala, Kadimo Oremeng is suing for P3 million as compensation from former Local Government, Lands and Housing permanent secretary, Elvidge Mhlauli and Botswana government claiming that he was fraudulently and unlawfully denied allocation to a plot on which Riverwalk mall presently stands.

Lawyers representing all the three parties agreed in chambers that further particulars and documents will have to be provided before the case begins. According to the agreed timeline the plaintiff will have to file declaration statements on June 28, while the defendants will file their pleas on July 13. The case will only start on August 27, 2010.

In his writ of summons Oremeng states that his application to build a shopping complex at what is now called Riverwalk mall was unprocedurally, without good cause, fraudulently and deceitfully frustrated by Mhlauli when he allocated this piece of land to Eddie Norman. As a consequence, Oremeng said he suffered damages in the sum of P3 million and maintains that government and Mhlauli, who was a government employee at the time, are liable.
