No Constitutional Formalities In Petition For Mercy

The Court of Appeal says presently there are no constitutional formalities to be followed in the preparation of the petition for mercy.

Judge President, Ian Kirby on Thursday, deliberating in a death row inmate Patrick Gabaakanye’s appeal, said the wildest discretion was allowed to the petitioner in formulating his representation.

The reasons were delivered following Gabaakanye’s fight to be availed ‘processes and procedure’ to be followed when applying for clemency. He is represented by attorney Martin Dingake.
