Motswagole defies the Chief Justice

The friction between Lobatse High Court Justice Tshepho Motswagole and Chief Justice Maruping Dibotelo seems to be intensifying.

The latest indication is that Motswagole recently declined to take orders from the Registrar and Master of the High Court to preside over a case involving the ruling Botswana Democratic Party (BDP) against the secretary of the Independent Electoral Commission (IEC), and Whyte Marobela as Second Respondent.

"The Registrar and Master of the Court initially allocated this matter to Justice Motswagole, but he declined to preside over it and when the Chief Justice was called to intervene he refused," said a South African Advocate Mark Antobus before Justice Terrence Rannowane yesterday, perhaps unaware of the standoff in the judiciary.
