Ex-Magistrate Disrupts Court Of Appeal

Former Magistrate Shavirai Mawere on Thursday morning disrupted proceedings of the Court of Appeal and nearly brought the court into disrepute.

When a panel of three judges was about to deliver judgment in Mawere’s appeal against Botswana Building Society (BBS), he stood up and submitted that he had written a letter to the Court of Appeal that asked Justice Isaac Lesetedi to recuse himself in the matter.

Before he could submit further, Court of Appeal President Ian Kirby cut him short and reminded him that it was too late for him to bring the application.  Mawere would have none of it. He continued with his submissions and was restrained by a court orderly who ordered him to sit down. Before he sat down, he asked the court to be excused but Kirby demanded that he sit down to hear the judgment.
