Botswana Defence Force (BDF) deputy commander Otisitswe Tiroyamodimo and attorney Temperance Ketshabile of Motlhala, Ketshabile Rabashwa Attorneys, will be tried on October 21, after the prosecution failed to present evidence on two counts of their alleged offences.

Both counts state that Tiroyamodimo gave false information to a person employed in the public service when he told the police officer investigating the case that Ketshabile was the one driving Tiroyamodimo's Toyota Land Cruiser when it collided with a Toyota Hilux near or at the Sir Seretse Khama Barracks in July 2010.

Counts one and two, which were not contested, read that on the day of the accident, Tiroyamodimo drove his car whilst unfit to drive through drinks or drugs and later on refused to provide a breath specimen. Submitting in the Broadhurst Magistrate's Court yesterday, attorney Banyatsi Mmekwa, for the accused, lambasted the prosecutors for trying to convict the duo when no evidence had been presented to prove the third and fourth counts.
