Court interdicts Govt for unlawful 3% increment

Justice Harold Ruhukya of the Industrial Court yesterday interdicted government’s unilateral three percent increment of public servants, stating that it was in breach of bargaining in good faith.

Botswana Federation of Public Sector Unions (BOFEPUSU) and its four-affiliate unions went to court seeking an interdiction of government’s unilateral salary hike, effective May 2016, as it was not decided at the Public Service Bargaining Council (PSBC).

Government lawyer Oteng Thamuku had argued that the PSBC was defunct as per the ruling by Justice Tebogo Maruping and therefore the employer had no one to bargain with.
