CoA prisons assault verdict soon

The Court of Appeal (CoA) will on April 21 deliver judgment in a case between the Commissioner of Prisons, Silas Motlalekgosi, and an ex-prisoner, Ishmael Olekile. In the matter, the Commissioner of Prisons is appealing a trial court judgment, which favoured Olekile who had instituted action for damages against the attorney general and the Commissioner of Prisons, for injuries suffered after he was unlawfully assaulted and tortured by prison officials while in prison in 2012.

In its judgment of May 28, 2015, the trial court had considered that Olekile had suffered pain as he was tortured, assaulted and stripped of dignity befitting other human beings and awarded him P30,000 with interest thereon at the rate of 10 percent per annum calculated from the day the judgment was passed until full payment is made.

In his appeal, Motlalekgosi, through the Attorney General, is seeking relief from CoA to set aside the judgment of the trial court, the judgement be entered in favour of the appellant and dismiss the action with costs.
