SELEBI-PHIKWE: Botswana Congress Party (BCP) plans applying to be friends of the court in a case between the Botswana Democratic Party and the Independent Electoral Commission (IEC). The ruling BDP has taken the commission to court over its refusal to accept the party's candidate for the Francistown West by-election.

Whyte Marobela, a losing candidate in the BDP primary elections had, two weeks ago taken the party to court, querying irregularities in the primary elections won by Ignitius Moswaane. On October 31, a day before the IEC was receiving nominations for the by-election, Justice Tshepo Motswagole ruled that until the party gave Marobela a fair hearing, the BDP candidate would be disallowed from the November 23 by-elections. Despite the court ruling, Moswaane tried and failed to register as a BDP candidate.

Moswaane and the BDP then approached the courts to challenge the IEC decision.
