In the battle for the control of the new billion pula industry in Botswana, the national lottery licence operator has fizzled out with the High Court re-affirming the Gambling Authority’s regulatory powers in awarding or not awarding the licence.

However, for the South African lotto operator, trading as Ithuba in Botswana, which launched an urgent application seeking to wrestle the licence from a citizen bidder, Grow Mine, it was a day to forget, as the High Court found its case wanting on multiple grounds, from preliminary points to arguments.

Sefalana, which had been the majority shareholder at the citizen lottery company, Grow Mine, financed the defence against the Ithuba’s challenge with the retailer’s managing director, Chandra Chauhan deposing an affidavit for Grow Mine. The Gambling Authority also stuck its head in to defend its decisions against the South African company.
