MISA on Intelligence and Security Service Bill, 2006

MISA Botswana wishes to state unequivocally, its concern regarding the fast tracking of the Intelligence and Security Bill No. 23 of 2006, through Parliament. We hear that the Bill has already gone through its second reading and is awaiting its third and last reading.

What is of grave concern is that, despite obvious and clear weaknesses regarding oversight provisions for this Bill which the Minister of Justice himself has publicly acknowledged, he still has pushed for the Bill to go through Parliament without addressing those short-comings. This is really a travesty of justice by those tasked with overseeing the adherence to democratic principles.

Civic society has positively indicated to the relevant ministry through various gatherings, areas of concern but to no avail. It is even more worrying that such a Bill comes when Botswana does not have a freedom of Information Act (FOIA). Such an Act has been in abeyance for the past 11 years without any progress on the side of the Government.
