TAWU registration and recognition is not in question

TAWU Executive would like to correct the misleading article in Mmegi edition of Tuesday, January 31, 2012, Vol. 29 No.14, titled TAWU loses as court affirms BOFEPUSU recognition.

The opening statement refers to the 'existence of TAWU' and creates an impression that TAWU's recognition or registration is in doubt following the negative verdict in the Bargaining Council case. This of course is false and misleading. It is clear from the article that the reporter was excited by the outcome of the case, which caused the biased, opinionated reporting.

The case failed only on the requirements for urgency. The judge was not convinced by the grounds advanced by TAWU's lawyer for the matter to be heard on an urgent basis, and not which union is more qualified to be in the Bargaining Council. The court in its wisdom was not convinced that the budget speech, the end of the financial year, ongoing negotiations, urgent transformation of Tertiary institutions and all the factors we raised were reason enough to grant us an order.
