In response to Ngakaagae's death penalty article

I have read the attorney Kgosietsile Ngakaagae's article on The Sunday Standard. It has left me more confused than satisfied about the Motswagole ruling on the abolition of the sentencing procedure for the death penalty.

If anything, it has left me more convinced that the decision is very WRONG and will not see the light of day come the next Court of Appeal. In fact Court of Appeal Judge President Ian Kirby should convene a Constitutional Court (The Full Bench of The Court of Appeal) right now and assemble the best legal minds in the Commonwealth to man such Court.

One thing that is clear from Ngakaagae's article is that the Chief Legal Advisor of Government - the Attorney General - was neither represented nor asked to make representations before the piece of legislation was struck off as being unconstitutional.
