BFTU welcomes BOPEU judgment

Botswana Federation of Trade Unions (BFTU) welcomes the judgment of the Industrial Court that was passed last Wednesday (16.03.16) by Judge President Tebogo-Maruping, in the case of Botswana Public Employees Union (BOPEU) vs Botswana Landboards and Local Authorities Workers Union & eight others.

As is common knowledge, following its rule nisi issued on February 22, 2016, the Court confirmed its ruling in favour of BOPEU, with a small, but significant, caveat.

The addition is that the Court directed that ALL recognised public sector unions should, within thirty (30) days, together with Government as the employer, sit under the mediation of the Commissioner of Labour, to revisit the Constitution of the Public Service Bargaining Council (PBSC). According to the judgment, the purpose for this mediation is for the parties to come up with a lawful, fair and reasonable formula for the representation of trade unions in the PSBC.
