When men tussle over mules, the judge throws them out

FRANCISTOWN: Justice Moses Chinhengo of the Francistown High Court has criticised a magistrate for dismissing a civil application on the basis that the parties did not have a written agreement.

The case involved Gaafiwe Phetogo and Baemedi Lekwapa whereby the plaintiff sued the respondent before the magistrate, alleging that he (Lekwapa) owed him P5,000 for training his two mules in 2009.

In her ruling, the magistrate dismissed the application, saying that in the absence of a written agreement, she was unable to find that Lekwapa owed Phetogo the said money.
