Top Cop Appeals Defilement Conviction And Sentence

FRANCISTOWN: A former police Inspector at the Gumare Police Station convicted of defilement last weekend, appealed his conviction and 10 years' sentence.

Othusitse Marape, 45, was convicted for having sexual intercourse with the complainant who was by then under the age of 16 years some time in March 2006 at Gumare.

Moving Marape's appeal before Acting Justice, Terrence Rannowane, attorney, Tshekiso Tshekiso, of Kgalemang and Associates submitted that the trial magistrate did not adopt the cautionary rule. Tshekiso submitted that it was a trite law that in sexual act cases, especially when the complainant was a minor, the trial court must adopt the cautionary rule.
