Theft accused want stay of prosecution

FRANCISTOWN: A defence lawyer representingtwo people charged with possession of stolen property has applied for a permanent stay of prosecution for his clients.

Dumisani Mokobi of MCM Moseki Attorneys argued that the state had delayed to try Julius Gobela and Koriwa Taboka within a reasonable time, after they were charged with the offence on September 16, 2010. The state contends that the two were in contravention of section 318 of the Penal Code (CAP 08:01) as read with section 33 of the penal
code (CAP 08:01).

According to the charge sheet, the two were found in possession of two hind quarters of a young bovine aged less than one and a half years, two front quarters of a young bovine of less than one and a half years, two front quarters of a mature beef animal and three hind quarters of a mature beef animal at Tjose Butchery at Dukwi Dillage, which the police suspected was stolen property.
