Student sues govt for private partsďż˝ injury

A Form Three student whose scrotum was left permanently injured after he was assaulted by a teacher, is suing the government for P460, 000. The 15-year-old boy (who cannot be named for ethical reasons) of Kwena Sereto Junior Secondary School in Molepolole, was on May 13, 2013 allegedly beaten with a stick by his Setswana teacher known as Mrs Mmabothata.

On December 4, 2014, his lawyer, Martin Dingake, noticed the Attorney General, representing the Ministry of Education and Skills Development, of the student’s intention to sue at the expiry of 30 days.

“The cause of action for the claimant’s claim is a delictual claim for damages arising out of physical harm [assault], further and/or alternatively negligence,” wrote Dingake on behalf of his client.
