State reinstates rape charge against 'insane' man

FRANCISTOWN: A 'mentally disturbed' man here may find himself in trouble after the state reinstated a rape charge against him.

The charge was withdrawn on Monday but reinstated the following day after the state submitted that due process was not followed when the charge was provisionally withdrawn.The 30-year-old man of Donga location in Francistown, who seemed confused during his appearance, is alleged to have raped a 22-year-old woman of the same location on October 3, 2012.Prosecutor Mangistu Chigala said the charge can only be withdrawn after a report is sent to the High Court and the president for consideration.

Magistrate Masie Moyo acceded to the state application and granted the accused bail, on condition that he provides two sureties, does not interfere with witnesses, binds himself with P1,000 and does not commit a similar offence while on bail.The accused was also ordered to provide an alternative place of abode that is not in the vicinity of the complainant's residence and appear in court whenever he is needed.Meanwhile, two Zimbabwean men appeared in court to face a single count of being unlawfully found in possession of elephant tusks weighing 0.9 kg. The ivory is worth P1,094.
