The judgement comes after Pastouchenko's lawyers Fashole-Luke brought to the attention of the court that there was nothing on record of trial proceedings and that some of the prosecution witnesses had not taken an oath or made an affirmation before giving evidence.
Pastouchenko was convicted and sentenced to seven years' imprisonment by the Gaborone Magistrates Court on a single count of defilement. However, on Friday Justice Newman found that there were fatal irregularities by the trial magistrate.
