Rape convict pleads misjudgement

FRANCISTOWN: Justice Maphosa, who is appealing against a 2004 rape conviction and 10 year sentence imposed by Masunga Magistrate Mompoloki Taolo, will soon know whether his appeal has been successful.

Maphosa's main submission is that Taolo passed sentence that was beyond his jurisdiction. Then, Taolo held the position of Magistrate Grade One.

He told Justice Moses Chinhengo that Taolo said that the mandatory minimum sentence of rape is 10 years.
