Prosecutor recognises accused from previous matter

FRANCISTOWN: A prosecutor who recognised an accused person, Dumizweni Mpofu from a previous case gave evidence in court last week.

Mpofu and two others before court are charged with robbery on the morning of September 9 last year. Bojang told the court that he knew the accused person because he has dealt with him before in a different matter last year. "You were on a case last year and that is why I recognized you when the complainant pointed at you," the judge said.
Giving evidence, the prosecutor said he was on duty and went to check on a patient at the hospital, when he came across the complainant.
"Around minestone area, a woman flagged me down and I stopped. She was asking for assistance and she was barefoot and her hands were tied together with a bandage", he said. Bojang said that the woman, who identified herself as Letsatsi, said that three men entered her house and attacked her. Bojang said that he left with the woman towards the Minestone Park as she said the men had gone in that direction. "When we got to the park she pointed to three men who were walking ahead of us. They all wore black jackets. When they saw us they started running towards the Gallo Shopping Complex," Bojang went on.
He said he recognised the accused person before then.
"I knew who you were. You know who I am and you even know my name. There is no way I can confuse you with anyone else," he said.
Bojang told the court that after some minutes the backup called and told him that they had managed to arrest one of the three men and they were bringing him to the charge office. Bojang identified the bandage that was used to tie the complainant and a tie.
During cross-examination the accused could not control his temper.
The accused said he did not know the prosecutor and that he did not go to the complainant's house. He said that the robbery was staged. Why did she not scream to the neighbours for help? Why did she have to wait for you? he said.
He said that he could not have run in the direction of the shopping center if he had committed the crime. The case continues before magistrate Thato Mujaji.
