Prosecution agree with defence in theft case

The prosecution in a P158,000 theft case has agreed with the defence to admit statements from 10 state witnesses.

The prosecutor, Obakeng Matlhodi told Village Magistrate Ephraith Ndegwa that they still have to get six more witnesses. She successfully applied for trial to be held in January to allow the prosecution time to get the witnesses. Matlhodi is prosecuting in a theft case where the Thapong Visual Artist, Ray Tshenolo Gare is charged with the theft of P158,000 from Stanbic Bank. Gare who pleaded not guilty to the charge is said to have committed the offence on October 29, 2004.

Defence attorney, Busang Manewe confirmed the agreement with the prosecution but said that the trial be set for the last two weeks of January to avoid clashes with the Court of Appeal (CoA) session. "The CoA usually sits during the first two weeks of January, so it advisable to schedule the trial to the last week of January to avoid clashes with the CoA," Manewe said. The trial has been set for January 26 and 27 when the six remaining prosecution witnesses will give evidence. Gare who is out on bail was told not to forget the trial date due to the long lay-off. The mention date was set for January 12 to get an update on the remaining prosecution witnesses.
