Prosecution accuses Nchindo of delay tactics

The Directorate of Public Prosecution (DPP) has accused former Debswana managing director Louis Nchindo and his co-accused of using multiple court applications to delay the hearing of their corruption case.

Last week, Nchindo and company launched a fresh application to 'freeze' the trial indefinitely until Justice Maruping Dibotelo of the High Court had listened to their earlier application for a review of a court order issued by Regional Magistrate, Lot Moroka on February 26th. Nchindo's lawyers said their clients might not get a fair trial if the criminal case resumes before Dibotelo determines the application.

In its replying affidavit filed yesterday at the Lobatse High Court, the state indicated that it is opposing Nchindo's bid to postpone the trial because the case, which was registered in 2007 is ripe for trial. Nchindo, his son Garvas Nchindo, former Debswana employees Joseph Matome and Jacob Sesinyi have been slapped with corruption charges by the DPP. They want the trial postponed and have indicated that they will not plead until Dibotelo has listened to their application to have the charges against Nchindo clarified.
