Polygamous marriage nullified

FRANCISTOWN: The second marriage of a member of the International Pentecost Church (IPC) has been cancelled after the High Court ruled that polygamy is not legal under the Marriage Act.

High Court judge Terrence Rannowane said that when Joseph Bashi Gampone married Osupile Nancy Potokwane in 2009, he was still married to Ethel Gampone thus contravening Section 13 of the Marriage Act.

According to Section 13 of the Marriage Act; "No person who has previously contracted a marriage under this part with a person still living may contract a marriage under this part or in accordance with any customary, Muslim, Hindu or other religious rites unless the previous marriage has been dissolved or annulled by a sentence of court."
