Murder convict, Matshidiso Ntwaagae will know her fate tomorrow, Justice Onkemetse Tshosa of the Lobatse High Court has said.

However, she may not get the death penalty after the state prosecutor concurred with the defence counsel, Shame Taimu that there were extenuating circumstances during the commissioning of the murder.

Taimu submitted before Justice Tshosa that on the fateful day Ntwaagae killed her then boyfriend Pule Letota, she had been consuming alcoholic beverages with the deceased and their friends. He said it is not in doubt that Ntwaagae did take wine for some time and this was supported by some state witnesses. He stressed that intoxication has been found to be an extenuating circumstance by the courts of Botswana. "Whether the accused was drunk or not is neither here nor there," Taimu submitted.
