Government intends coming up with a marriage law that will enable married couples to switch to either in or out of community of property at any given time in their marriage. The Marriage Act is being revised to bring about this flexibility. This is one of the initiatives by the Ministry of Labour and Home Affairs.
The Married Persons' Property legislation, is currently at bill stage and is circulating for comments, in preparation for tabling before Cabinet. Under this bill, the department seeks to ensure that married people can change from marriage in community of property to out of community or vice-versa whenever they want. "Currently, it is impossible for married people to change the status of their marriage, even where it is necessary," said the director of Civil and National Registration Neo Lepang, while addressing Ntlo ya dikgosi on Friday. Other legislation under review include the Societies Act, which is also at bill stage while National Registration and Change of Name are at drafting stage.
