Nchindo Awaits Ruling

After listening to a gruelling three and half hours of legal debates in the Nchindo corruption case, Gaborone Village Chief Magistrate Lot Moroka said he will deliver a ruling on an application for the recusal of defence lawyers on September 18.

The case involves former Debswana managing director Louis Nchindo, his son Louis Garvas and former senior Debswana executives Joe Matome and Jacob Sesinyi. The Directorate of Public Prosecutions has applied for the recusal of Collins Newman law firm from representing the suspects.

The hearing of the application started at a furious pace on Friday when defence lawyer Chris Loxton took the floor to shred into pieces the argument advanced by the prosecution. Loxton confined himself to issues of jurisdiction. He argued that the Magistrates' Court does not have the jurisdiction to deal with an application that sought to take away rights conferred by the Constitution.
