NBB loses Multichoice appeal

Multichoice Botswana will continue to do their Dstv business in Botswana without a broadcasting licence after the National Broadcasting Board (NBB) failed in their second appeal against the company.

In a judgement written by Lord Coulsfield JA, the NBB's appeal was dismissed with costs, including the costs of senior counsel.

In his ruling, corroborated by two other presiding High Court judges, Judge president Patrick Tebutt and Judge of Appeal M. Ramodibedi, Coulsfield withheld the judgement of the High Court that said Multichoice is not a broadcaster and so should not be controlled by way of a broadcasting licence, the only tool the NBB currently has.
