Mukokomani appeals High Court decision

SELEBI-PHIKWE: Former Selebi-Phikwe mayor, Lekang Mukokomani's attorneys have served the council with court papers appealing the High Court ruling of April 18 in which he lost the case to the council.

The appeal seeks the Court of Appeal to reinstate Mukokomani as the mayor of Selebi-Phikwe, declare the decision by the council to remove him from the office irregular and illegal and for it to set aside the decision of the High Court in its April 18 judgement, as well as to direct the council and its mayor Godfrey Mbaiwa to pay the costs of the appeal.

Ditiro and Jani Legal Practice, acting for Mukokomani, base the appeal on the fact that after finding that the duty was on the council to show that it has the authority to remove Mukokomani from office by the way of a motion of no confidence, Motswagole failed to make a finding on whether this onus has been discharged.
