Ministry suffers another blow

The Ministry of Education has suffered another blow on Wednesday after the Court of Appeal ruled that it must pay University of Botswana (UB) students their June and July allowances.

The ministry had stopped paying the allowances forcing the students to move to the High Court for relief. The students succeeded in their bid but the ministry moved to the Court of Appeal to have the High Court decision reversed.

The case Court of Appeal dismissed the case with costs and said the ministry was in breach of contract it signed with the students. The court did not set the date for the payment saying that the law does not allow judges to order government to perform a certain performance on a specific day. The Court of Appeal said the case lacked merit because the ministry had an obligation to pay the students the June and July allowances.
