Mathokgwane, a rape case to answer?

State Prosecutor Boikobo Keaikitse countered James Mathokgwane's plea for discharge and acquittal yesterday, arguing that he did have a case of rape to answer.

Mathokgwane's lawyer, Moses Kadye pleaded before Broadhurst magistrate, Nehemiah Mgoni that the charges against Mathokgwane be scrapped because the prosecution had failed to positively identify the person who allegedly raped a nine-year-old girl at Old Naledi.

Kadye argued that although the state has shown that the young girl was raped, it had failed to establish the person who raped the young girl. He contested that the young girl had testified in court that it was not Mathokgwane who violated her.
