Man found guilty of rape

FRANCISTOWN: A man who claimed that he did not have forceful sex with a woman because she was his girlfriend has been convicted of rape by a Francistown magistrate.

Oageng Samson failed to convince Senior Magistrate, Kgololesego Segabo that the complainant was his girlfriend when he had sex with her in February 2010. The magistrate said that besides the act being unlawful, Samson had sex without the consent of the complainant. He stated that Samson is guilty because he used force to have sexual intercourse with the complainant. The convict is said to have assaulted the woman before dragging her to his place to commit the offence after they met at a bar in Matsitama. The woman testified that Samson forced her to go to his place and used a stick to intimidate her.

She said she does not know whether Samson used a condom or not because it was dark. She reported the matter to her sister the following morning who advised her to go to the police. Segabo said that other witnesses showed that force was used on the complainant. He said that young men should always listen when women say no to their sexual advances. Samson is in custody and will be sentenced tomorrow after undergoing an HIV/AIDS test.
