Magistrate erred so man is acquitted

FRANCISTOWN: A 29-year-old man of Francistown yesterday walked home a free man after the High Court acquitted him of charges of robbery because the magistrate had erred in dealing with the evidence before the court.

Joseph Dumano had appealed against both conviction and sentence. He was in 2010 convicted and sentenced to 10 years in prison by a Francistown magistrate for allegedly robbing a family of two Nokia cell phones worth P600.

In his grounds of appeal, the now free man, had argued that the trial court had erred in finding ample corroboration on the evidence that was cooked to secure a conviction. He also averred that there was totally nothing that linked him to the offence.
