Gaborone Chief Magistrate Lot Moroka has found Elvige Mhlauli guilty on the two counts that he had been charged with. Today the court will listen to his mitigation before he could sentence him. At the close of judgement on Monday, there was talk of the possibility of a custodial or a non-custodial sentence. GIDEON NKALA looks at what the statutes say on the sentences that could be imposed on the man.

Count one: Any person who, being employed in the public service, does or directs to be done, in abuse of the authority of his office, any arbitrary act prejudicial to the rights of another, is guilty of an offence.

Under general punishment offences (Section 33), the penal code stipulates: When in this code no punishment is specific for any offence, it shall be punishable with imprisonment for a term not exceeding two (2) years or with a fine or with both.
