Legal opinion divided over Kgafela de-recognition

As Local Government Minister Lebonaamang Mokalake prepares to recognise a new Bakgatla royal to take over from de-recognised Kgosi Kgafela II this week, legal opinion is divided as to whether government has the power to strip Kgafela II of his chieftaincy.

Kgafela yesterday confirmed in a letter he published in a Sunday weekly that some of his royal uncles have been invited by the Minister of Local Government today, where possibly his successor could be announced.

A source close to the court case in which Kgafela is being prosecuted for a wide range of criminal matters involving flogging of people, and destruction of the Mascom tower, said the minister is well within his powers to strip the Bakgatla leader of bogosi.
