Lawsuit threat shakes councillors

Kweneng District councillors were in a dilemma yesterday after they were told the council might be sued if it reports a landlord to the Directorate on Corruption and Economic Crimes (DCEC) over a questionable lease agreement.

Council secretary, Wazha Tema delivered a damning report alleging violation of tendering procedures and possible corruption by council officers when they leased space to house the Mogoditshane-Thamaga sub-district offices. On Monday some councillors said the matter should be reported to the DCEC and that the council should vacate the offices located in Nkoyaphiri.

In his report Tema said the negotiation and procurement team unilaterally agreed with the landlord, Fidelity Print Mark, to rent the premises to council without seeking the approval of the Finance Committee. The report states that the government rate is P49 per square metre, yet the negotiation team signed for Fidelity Print Mark's P56.14 per square metre offer without even bothering to negotiate for a lower figure. Tema is concerned that the approved plans measure 1,846.62 square metres for floor area, while the actual measurement of the building as built 1,240 square metres. "This being the interior wall measurements, which would imply that the landlord measured using the exterior wall measurement whereas the practice in the estate industry is to measure the interior wall. Applying the rate of P56.14 square metres to the actual measurements 'As Built' we would be paying a rounded figure of P70,000 before VAT. It is in this regard that council engage the lessor to rectify the anomaly," he said in his report.
