Ketlogetswe wants Judge to recuse self

Justice Gaopalelwe Ketlogetswe has through his attorney Oteng Motlhala applied for recusal of Justice Godfrey Dijeng from a matter in which Ketlogetswe is challenging disciplinary action against himself.

Ketlogetswe approached courts on urgency to interdict President Mokgweetsi Masisi, Judicial Service Commission and Chief Justice Terrence Rannowane from instituting disciplinary action against him in his ongoing dispute with Rannowane. Ketlogetswe, who made news headlines last year after he accused the Chief Justice and the Minister for State President, Kabo Morwaeng of judicial interference with regards to Lobatse legislator, Dr Thapelo Matsheka’s case, has filed a law suit against the above mentioned seeking an interdict. At the time of the news blitz, Ketlogetswe had made a series of accusations against the pair alleging they had tried to influence his decision regarding the case in which Dr Matsheka was accused of kidnapping and killing a seven-year-old Lobatse boy Tlotso Karema for ritual purposes.

The aggrieved judge’s interim interdict application was a result of reporting CJ to Masisi who then referred his (Ketlogetswe's) complaint to the JSC as he does not want the Commission to deal with his matter. Advocate Duma Boko who was instructed by Motlhala represented Ketlogetswe in the brief court appearance. He argued that Radijeng was not the suitable judge in the matter as he is currently Acting Chief Justice while Chief Justice office is 3rd respondent in the matter. He said despite the Acting being from 15 December2022 to 08th January 2023, Radijeng could be indebted to thank CJ as there are financial benefits to the appointment. He further argued that it raised eyebrows that Radijeng was solely selected for the matter. "It raises eyebrows that while other matters involving judges were empanelled, this one was given to your Lordship alone despite that he makes one of the panels for other cases. And now he is trusted with this one alone. It will be in the best interest of everyone if your Lordship recuses himself, " Boko said. State attorney, Phadza Molebatsi, said they were not ready to respond to the recusal application as they only became aware of it today morning before heading to court. Radijeng would then postpone the matter to Friday 6th to give respondents a chance to develop their position.
