Kalafatis' suspect walks free

LOBATSE: The Botswana Defence Force (BDF) Military Intelligence officer, Dzikamani Mothobi, has been acquitted and discharged over the murder of John Kalafatis.

However, Mothobi's colleagues, Gotshosamang Sechele, Ronny Matako and Boitshoko Maifala will be jailed for 11 years each as their convictions were on Friday confirmed by the Court of Appeal (CoA). A panel of three judges comprising of Lord Alistair Abernethy, John Foxcroft and acting CoA judge, Steven Gaongalelwe, acknowledged Mothobi's submissions that the High Court was not competent to have convicted him of being an accessory after the fact as the only charge he faced was that of murder.

Mothobi's attorney, Advocate Michael Hellens submitted that for Mothobi to have been convicted of an offence of being an accessory after the fact, he needed to have been charged with that offence first.
