Judiciary should hold all accountable-UCT law expert

A law expert from the University of Cape Town, Professor Hugh Corder has said that the role of the judiciary in a democracy such as Botswana is to hold both the executive and legislature accountable to the people.

Making a presentation last Thursday night in Gaborone, he said that the constitutions of Botswana and South Africa were influenced by the Westminster model which promotes the equitable distribution of power among the three arms of government - the judiciary, the executive and the legislature. He argued that majoritarian democracy disadvantages the population because it only affords the electorate an opportunity to make their voice heard once in five years, during elections.

"In between the general elections there is no role for the electorate, their popular voice is seldom heard unless if it comes through the media or provision for a referendum," he observed. He said that there are consequences for rights protection and division of power between the three branches of government.
