Judgement reserved in Radibe case

FRANCISTOWN: Justice Mpaphi Phumaphi has reserved judgement in a case in which former Sedibelo Junior Secondary School head, Japhta Radibe has taken the Teaching Service Management (TSM) to court for forced early retirement.

Radibe is the current Botswana Teachers' Union (BTU) president. He was forced to retire from teaching on April 1, 2007 by the former TSM director Opelo Makhandlela.

Makhandlela had earlier attempted to retire the trade unionist but backed down after he realised that he made a mistake. During the hearing of the case in court, lawyer Phazha Kgalemang for Radibe submitted that it was a violation of natural justice when the then TSM director rescinded the first decision to fire his client. Kgalemang said the Teaching Service Act required that when the director retired Radibe, the rules of natural justice could have been observed. "The decision of the respondent should be set aside because it has no leg to stand on," he submitted. Phumaphi concurred with Kgalemang that the director in the first letter acknowledged the irregularity.
