FRANCISTOWN: Justice Moses Chinhengo has recommended that the legislature amend section 302 of the penal code.

The section deals with the offence of office breaking and theft. Chinhengo wants an increase in the prescribed punishment to a maximum of 14 years imprisonment so as to align the punishment under section 317 of the penal code that deals with the offence of receiving stolen property.

The maximum sentence prescribed for receiving stolen property is a term of imprisonment not exceeding 14 years. The offence under section 302 (a) attracts a term of imprisonment not exceeding seven years.
