Judge says insults are not defamatory among Basarwa

FRANCISTOWN: Justice Mpaphi Phumaphi of the High Court has ruled that abusive language is not defamatory among Basarwa.

The judge said that in the Sesarwa community, abusive language is culturally acceptable and hence is not injurious to reputation.

He made the ruling in an appeal lodged by a Herero man dissatisfied with a magistrate's decision to dismiss his defamation case against a Mosarwa woman. Kadisosa Watjuera appealed to the High Court because he was not happy with a Letlhakane magistrate who dismissed his P10,000 suit against Ontshotile Dase early this year.
