Judge reinstates RIPCO exit package

High Court Judge Michael Mothobi has found as invalid and void a notice to repudiate an exit package agreement between Rural Industries Promotions Company Botswana (RIPCO-B) and its employees' union.

 Justice Mothobi set aside the notice on the basis that Dr Matz Mosienyane, who wrote the letter of notice, did not have the authority to revoke the agreement between the company and the National Amalgamated, Local and Central Government and Parastatal Workers Union (NALCGPWU). He ruled that the agreement, which the two parties signed in April 2012, stands and is binding.

In his judgement, Justice Mothobi said no resolution has been filed to show that Mosienyane had authority from RIPCO to revoke the agreement arrived at by the two parties. Mothobi dismissed the claim by Mosienyane that he had written the letter in his capacity as Managing Director of the company, as at the time he wrote the letter the latter did not hold that position. Mothobi said when a board seeks to give authority to one officer or agent to act on its behalf there are "conditionalities" that are followed.
